These Terms & Conditions (“Terms”) govern your use of the AI Photo Fixer mobile application (the “Application”) provided by eSimply Apps (“we”, “us”, “our”). By downloading or using the Application, you agree to these Terms. If you do not agree, do not use the Application.

1) Service Description

AI Photo Fixer provides AI‑assisted image enhancement and transformation features (e.g., enhance, deblur, colorize, retouch, AI makeup). Free users may see advertising; optional subscription removes ads and may unlock additional features. Certain free features may require watching an ad when available.

2) Eligibility

You must be at least 13 years old to use the Application. If you are under 18, you represent that you have consent from a parent or legal guardian.

3) User Content & License

• You retain ownership of photos and content you submit (“User Content”).
• You grant us a limited, non‑exclusive, worldwide license to process your User Content solely to provide the features you request (e.g., upload to our processing servers, generate and return results).
• We do not claim rights to use your User Content beyond fulfilling the AI processing requested by you.
• Free (non‑subscribed) saves may include a visible watermark or branding on the resulting image.

4) Prohibited Use

You agree not to:

• Upload content that is illegal, harmful, abusive, harassing, defamatory, hateful, or infringing.
• Violate any third‑party rights, including privacy, publicity, or intellectual property rights.
• Reverse engineer, decompile, or otherwise attempt to access the Application’s source code.
• Use the Application for biometric identification or any unlawful surveillance or discrimination.

5) Subscriptions, Billing & Trials

• Subscriptions are billed via the app store (e.g., Google Play) and auto‑renew unless canceled at least 24 hours before the renewal date.
• Manage or cancel your subscription in your app store account settings. We do not handle refunds directly; refunds are subject to the app store’s policies.
• We may offer trials or promotional pricing. Eligibility and duration are at our discretion and may change at any time.

6) Third‑Party Services

The Application integrates third‑party SDKs for analytics, crash reporting, advertising/mediation, attribution, and subscription management (e.g., Firebase Analytics/Crashlytics, AppLovin MAX / AdMob / Unity Ads, Adjust / AppsFlyer, RevenueCat). Use of these services is subject to their respective terms and policies. We are not responsible for their actions or content.

7) Privacy

Your use of the Application is also governed by our Privacy Policy, which explains how we collect, use, and share information. Please review it carefully: https://aiphotofixer.pages.dev/privacy

8) Availability & Modifications

• The Application (including AI models and features) may change, be interrupted, or discontinued at any time without notice.
• We may update these Terms from time to time. Continued use after changes means you accept the revised Terms.

9) Intellectual Property

• The Application and all related content (excluding User Content) are owned by us or our licensors and protected by applicable IP laws. No rights are granted other than those expressly set out in these Terms.
• You may not use our trademarks, logos, or branding without our prior written permission.

10) Disclaimers

• THE APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, AND AVAILABILITY.
• We do not warrant that results will be accurate or error‑free, or that the service will be uninterrupted or secure.

11) Limitation of Liability

• TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPLICATION.
• OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE APPLICATION SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

12) Indemnification

You agree to indemnify and hold harmless eSimply Apps and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your misuse of the Application, your User Content, or your violation of these Terms.

13) Termination

We may suspend or terminate your access to the Application at any time, with or without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties.

14) Governing Law

These Terms are governed by and construed in accordance with the laws applicable in your country/state of residence unless otherwise required by local consumer law. Any disputes shall be subject to the exclusive jurisdiction of competent courts in that jurisdiction, unless a different venue is required by law.
